General Terms and Conditions of Sale

1. ELYSIS COLLECTION

The company LA PRESTATION IMMOBILIERE – LPI, operating under the trade name ELYSIS COLLECTION, is a limited liability company with a share capital of €2,500. It is registered with the Paris Trade and Companies Register under number 790 242 036. The company’s registered office is located at 31 boulevard de la Tour-Maubourg, 75007 Paris, France. Its VAT identification number is FR45790242036.​

ELYSIS COLLECTION manages a website accessible at www.elysiscollection.com, offering travelers the opportunity to rent high-end furnished properties for short-term stays, commonly referred to as “seasonal rentals.”​

2. Preamble

These General Terms and Conditions of Sale define the rights and obligations of the company LA PRESTATION IMMOBILIÈRE – LPI, operating under the trade name ELYSIS COLLECTION (hereinafter referred to as “ELYSIS COLLECTION”), and the Client, within the framework of booking high-end seasonal stays on the website www.elysiscollection.com (hereinafter referred to as “the Site”) (hereinafter referred to as “the General Terms and Conditions”).​

The Client refers to any adult individual who reserves a property rental or stays in a property offered for seasonal rental by ELYSIS COLLECTION (hereinafter referred to as “the Client”).​

The property owners have entrusted ELYSIS COLLECTION with the management and/or concierge services of the properties offered for seasonal rental on the Site (hereinafter referred to as “the Owners”).​

ELYSIS COLLECTION acts as an agent responsible for managing the properties directly offered for rental by the Owners. ELYSIS COLLECTION does not rent the properties directly to Clients.

3. Acceptance 

It is the responsibility of the Client of the Site to carefully read all the conditions related to the rental, as specified on the Site during the search and confirmation of the reservation. The General Terms and Conditions may be modified at any time without prior notice.​

The Client is irrevocably bound to the reservation commitment made as soon as they check the mandatory box “I have read and accept the General Terms and Conditions of Sale.” The present General Terms and Conditions then apply without restriction to their reservation.​

Pursuant to Article L.221-28-12° of the French Consumer Code, the right of withdrawal available to the consumer for contracts concluded at a distance cannot be exercised for contracts concerning accommodation services, other than residential accommodation, which must be provided on a specific date or during a specified period. Consequently, the Client does not benefit from any right of withdrawal beyond the confirmation of the reservation.

4. Processing of personal data

The information provided by the Client is recorded in a computerized file by ELYSIS COLLECTION in its capacity as data controller. Certain information must be mandatorily provided to ELYSIS COLLECTION at the time of Reservation; failing to provide such information will unfortunately prevent the processing of the request. The processing of personal data is necessary to enable ELYSIS COLLECTION to offer and execute a rental contract. The personal information collected is used to allow the Client to access all information concerning their reservation, to fulfill their requests, to offer similar services that may be of interest, to compile statistics, to subscribe to newsletters, etc.​

The Client is informed that, in order to ensure the proper execution of the service, their data may be communicated to subsidiaries and partners of ELYSIS COLLECTION, which may be located outside the European Union, in strict compliance with the Client’s rights regarding personal data protection and in accordance with applicable legislation.​

ELYSIS COLLECTION commits not to transfer or sell personal data concerning the Client to non-partner third parties. The Client’s data is retained for the duration of the contractual relationship and for the necessary period to comply with legal or regulatory obligations. In accordance with the French Data Protection Act No. 78-17 of January 6, 1978, as amended, the Client has the right to access, object (notably to the sending of marketing communications), rectify, limit, and delete their personal data, as well as the right to data portability. The Client also has the right to define directives concerning the fate of their personal data after their death. In accordance with Article L.223-2 of the French Consumer Code, the Client has the option to register on the telephone solicitation opposition list: https://www.bloctel.gouv.fr/.​

5. Destination

The present General Terms and Conditions and, where applicable, the rental contract, pertain to the short-term rental of furnished tourist accommodations or bed and breakfast rooms. Such rentals cannot constitute the Client’s primary or even secondary residence, and the Client is prohibited from conducting any commercial, artisanal, or professional activities within the premises. Consequently, the Client cannot invoke the legal provisions applicable to residential leases, particularly those concerning the right to remain in the premises.​

6. Reservation 

The Client makes their reservation on the ELYSIS COLLECTION website.​

They select the properties and/or optional services. They acknowledge having read the nature, purpose, and booking procedures of the optional services available, specific to each property, on the Site, and having requested and obtained all necessary and/or additional information to make an informed reservation.​

The Client commits to being present on-site during the reserved stay and is solely responsible for their choice of properties and/or optional services and their suitability to their needs, such that ELYSIS COLLECTION or the Owners cannot be held liable in this regard.​

The reservation is deemed accepted by the Client at the end of the booking process. The validation of the reservation is conditional upon the Client’s acceptance of these General Terms and Conditions by checking the box “I have read and accept the General Terms and Conditions of Sale.”​

The Client agrees to fill in all required information on the reservation request form on the Site, guaranteeing the accuracy and truthfulness of the data provided.​

In certain cases, during the reservation on the Site, a seasonal rental contract is established in addition to the acceptance of these General Terms and Conditions between the Owner and the Client (hereinafter referred to as “the Contract”).​

ELYSIS COLLECTION acts as an agent for the Owners located in France and abroad and is not a party to the Contract.​

Once the properties and/or optional services are definitively chosen by the Client, the booking procedure requires reviewing and accepting these General Terms and Conditions and, if applicable, the electronic signature of the Contract to validate the reservation.​

When the reservation is confirmed, the Client receives an acknowledgment by email, including the reservation number, a summary of the reserved properties and/or optional services, the reservation date, and the address of the establishment where the Client can send any complaints, if necessary. If a Contract needs to be signed, it is sent by separate email.

7. Product description 

The descriptions and photographs visible in the property listings on the Site are presented in good faith and correspond to the accommodations offered by ELYSIS COLLECTION.​

However, the images in the ancillary sections of the Site (“This place offers you” and “Consider booking your activities”) are purely illustrative and aesthetic in nature. These images are in no way contractual, which the Client acknowledges and accepts.​

8. Prices

Rental prices are expressed in Euros.​

The rental price communicated on the Site is the price set by ELYSIS COLLECTION corresponding to the selected stay duration. This price includes the use of the property and the associated services mentioned on the Site.​

Additional or optional services are offered on the Site. If a price is indicated, it is for informational purposes only.

These additional services will be charged:​

  • either at the time of booking on the Site by the Client, subject to availability,​
  • or during the stay directly with the providers of the proposed activities, subject to sufficient prior notice to guarantee access to the requested activities and acceptance of the quote provided by the Client.​

The amount of the tourist tax will be paid by the Client via the Site, if applicable, at the time of booking in accordance with local regulations.s. 

9. Payment Methods

Payment shall be made exclusively in euros, either by bank transfer, credit card, PayPal, or Alma (if displayed during checkout). All available payment methods are displayed in the payment section and may be subject to change.​

9.1 Payment by Credit Card

Credit card payments on the Site are secured and encrypted via Stripe using the TLS (Transport Layer Security) protocol. You will be required to provide your credit card number, CVC code, and expiration date.​

The following credit cards are accepted: Carte Bleue, Visa, MasterCard, Maestro, Amex.​

Any payment that is irregular, ineffective, incomplete, or fraudulent for reasons attributable to the Client will result in the cancellation of the reservation at the Client’s expense, without prejudice to any civil or criminal action against them.

9.2 Payment via Alma

At the time of payment, the Client is redirected to Alma’s server to finalize their installment payment and obtain the details of their monthly installments. The Client will then be invited, prior to executing the payment, to read and accept Alma’s Terms of Use and Privacy Policy. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure. Alma is a telepayment manager and issues an electronic certificate that serves as proof of the amount and date of the transaction in accordance with the provisions of Articles 1364 and following of the French Civil Code.​

9.3 Payment via PayPal

During the reservation, the Client must enter their PayPal-associated email address and PayPal password. If the Client does not already have a PayPal account, they will be directed to a PayPal account creation page at the time of payment, allowing them to use this payment method.​

9.4 Payment by Bank Transfer

All payments by bank transfer are made after sending a reservation request to the following address: reservation@elysiscollection.com, subject to the availability of the property. ELYSIS COLLECTION’s bank details (RIB) will be communicated to the Client by email in response to the initial request.​

In the absence of receipt of the bank transfer within three (3) business days from the receipt of ELYSIS COLLECTION’s bank details, the reservation will be considered canceled.

10. Security deposit

10.1 Before the Client’s Arrival

The Client is informed that the security deposit for a stay in one of the properties offered by ELYSIS COLLECTION corresponds to the amount displayed on the Site. The amount of the security deposit is reiterated during the reservation process, prior to the Client’s payment, in the reservation confirmation email, and in the Contract to be signed, if applicable.​

The Client acknowledges and agrees that they are required to pay this amount at the time of reservation via the Site; this amount will be debited from the Client’s bank account simultaneously with the reservation payment.​

The Client will receive a summary email of their purchase, including the amount of the security deposit, and is informed of the conditions under which it may be retained by ELYSIS COLLECTION in accordance with these General Terms and Conditions and the Contract, if applicable.​

10.2 Upon the Client’s Departure

The security deposit will be refunded to the Client within two (2) weeks following the end of their rental, after deducting any amounts retained in accordance with the conditions specified below.​

Without prejudice to any specific conditions applicable to each property offered for rental, the security deposit paid may be retained by ELYSIS COLLECTION in the following cases, without limitation:​

  • Material damage caused to the rented property by the Client during the stay;
  • Abnormally dirty or untidy condition of the rented property; cleaning fees may be deducted from the total amount of the security deposit;
  • Violation of the property’s rules by the Client as provided in Article 9 of these General Terms and Conditions and/or in the terms of the Contract, if applicable.
  • Any additional costs not included in the initial rental price may be deducted from the security deposit.​

In the event of a deduction from the security deposit, ELYSIS COLLECTION will be required to provide a detailed explanation of the deductions made and refund the balance, if any, to the Client within two (2) weeks following the end of the rental.​

In all cases, ELYSIS COLLECTION reserves the right to:​

  • Invoice the Client for additional damages by justifying and documenting such additional charges if the amount of the security deposit is insufficient to cover the costs;
  • Initiate legal proceedings against the Client in the event of non-compliance with the General Terms and Conditions and the Contract of the rented property by the Client;
  • File a claim with its insurance covering damages caused to the rented property.​

11. Customer’s obligation

The Client agrees to:

  • Pay the reservation amount under the agreed terms.​
  • Not assign or sublet the rented property.​
  • Notify ELYSIS COLLECTION as soon as possible in the event of an urgent repair during the rental period, allow ELYSIS COLLECTION or any third party appointed by them to carry out the necessary repairs, and not claim any rent reduction as a result.​
  • Use the rented accommodation and its furniture and equipment peacefully, according to their intended purpose, and be responsible for any damage or loss that may occur during the rental period in the property of which they have exclusive use.​
  • Maintain the rented property and return it in good condition of cleanliness and repair at the end of the rental.​
  • Keep the sanitary, electrical, and heating installations in perfect condition, taking all necessary precautions.​
  • Avoid any noise likely to disturb the neighbors, particularly noise from radios, televisions, speakers, and other devices.​
  • Assume sole responsibility in case of complaints about neighborhood disturbances.​
  • Not take any action against ELYSIS COLLECTION in case of theft or damage in the rented premises.​
  • Respect the maximum number of people allowed in the premises, as specified in the description provided and the number indicated in the Contract, if applicable.​
  • Comply with the prescribed use for specific equipment and/or installations of the rented property, such as a jacuzzi, swimming pool, or sauna.​
  • Adhere to the pet declaration or prohibition policy of the rented property.​
  • Observe the no-smoking policy inside the rented property, if explicitly stated in the listing or in the Contract, if applicable.​
  • Follow safety rules and/or usage instructions for electrical or gas equipment.​
  • Comply with the recycling and/or waste disposal rules established for the rented property.​
  • Respect the departure times unless prior written agreement from ELYSIS COLLECTION is obtained; otherwise, as a penalty for this delay, an additional day’s rental may be charged.​
  • Use the swimming pool, if applicable, while respecting the safety measures in place. The tenant releases the Owner and ELYSIS COLLECTION from any liability concerning injuries, material and/or bodily damages caused or suffered by them or by a third party during the rental period. The use of the pool by children is under the full supervision and responsibility of their parents. Any minor child, as well as individuals who cannot swim, must be accompanied by a responsible, adult swimmer while in or around the pool.

12. Obligations of ELYSIS COLLECTION

ELYSIS COLLECTION undertakes to provide the Client with the rented property, in accordance with the descriptive state presented at the time of booking, and to comply with the obligations set out in the General Conditions and the Contract, where applicable.

13. Insurance 

ELYSIS COLLECTION does not include any insurance in the prices of the properties and/or optional services offered and does not offer any insurance contracts for sale.​

As the concept of civil liability (accident, fire, theft, etc.) varies according to the legislation of the countries concerned, Clients are advised to insure themselves with a solvent insurance company against risks of theft, fire, and water damage, both for risks related to their stay and for rental risks, including those related to the furnished furniture in the rented property. It is the Client’s responsibility to verify that their insurance policy specifically covers risks associated with seasonal rentals in France or abroad.

14. Cancellation policy

14.1 Cancellation by ELYSIS COLLECTION

In the event of cancellation by ELYSIS COLLECTION, the company commits to notifying the Client of its inability to fulfill the Reservation no later than fourteen (14) days before the scheduled start date of the stay. ELYSIS COLLECTION will refund the Client the full amount paid in advance without any compensation or recourse for the Client, or offer to reschedule the stay or provide accommodation in another property.​

14.2 By the Customer

For any cancellation by the Client, the cancellation conditions are described in the listing of each property and, for properties requiring a contract, in the Contract signed by the Client.​

Where applicable, refunds will be made by bank transfer within one (1) month from the acceptance of the refund by ELYSIS COLLECTION and the provision of the Client’s bank details.​

14.3 Special cases

For Wine Estates Outside France, the Cancellation Policies Are as Follows:

Quinta da Côrte

Entire Estate Rental

  • For a cancellation at least sixty (60) days before the Client’s arrival date, the total rental price will be refunded to the Client.​
  • For a cancellation between fifty-nine (59) and thirty (30) days before the Client’s arrival date, the Owner will retain 30% of the rental price and refund 70% to the Client.​
  • For a cancellation less than thirty (30) days before the Client’s arrival date, the total rental price is due by the Client.​

Per Room Rental

  • For a cancellation at least thirty (30) days before the Client’s arrival date, the total rental price will be refunded to the Client.​
  • For a cancellation between twenty-nine (29) and fifteen (15) days before the Client’s arrival date, the Owner will retain 30% of the rental price and refund 70% to the Client.​
  • For a cancellation less than fifteen (15) days before the Client’s arrival date, the total rental price is due by the Client.​

Tenuta Casenuove

  • For a cancellation at least sixty (60) days before the Client’s arrival date, the total rental price will be refunded to the Client.​
  • For a cancellation between fifty-nine (59) and thirty (30) days before the Client’s arrival date, the Owner will retain 30% of the rental price and refund 70% to the Client.​
  • For a cancellation less than thirty (30) days before the Client’s arrival date, the total rental price is due by the Client.​

Podere Lupinati

Entire Villas Rental

  • For a cancellation at least ninety (90) days before the Client’s arrival date, the total rental price will be refunded to the Client.​
  • For a cancellation between eighty-nine (89) and sixty (60) days before the Client’s arrival date, the Owner will retain 30% of the rental price and refund 70% to the Client.​
  • For a cancellation less than sixty (60) days before the Client’s arrival date, the total rental price is due by the Client.​

Single Villa Rental

  • For a cancellation at least thirty (30) days before the Client’s arrival date, the total rental price will be refunded to the Client.​
  • For a cancellation between twenty-nine (29) and fifteen (15) days before the Client’s arrival date, the Owner will retain 30% of the rental price and refund 70% to the Client.​
  • For a cancellation less than fifteen (15) days before the Client’s arrival date, the total rental price is due by the Client.

In the event of a discrepancy between the cancellation conditions specified in the property’s listing on the Site and those outlined in these General Conditions, the provisions of these General Conditions shall prevail.

15. Force majeure

Force majeure refers to any event external to the parties that is both unforeseeable and insurmountable, preventing either the Client or ELYSIS COLLECTION from fulfilling all or part of the obligations outlined in the General Conditions and, where applicable, the Contract.​

Events typically recognized by the jurisprudence of French Courts and Tribunals, as well as cases of pandemics and/or governmental restrictions, are considered force majeure or fortuitous events. In such instances, neither party shall be held liable to the other for non-performance of its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends the execution of the parties’ mutual obligations, with each party bearing the costs arising therefrom.​

In the event of a force majeure occurrence, the parties commit to negotiating in good faith to find a solution.​

16. Intellectual property

The Client is permitted to take photographs on the premises of the rented Property but does not have any rights for commercial exploitation or publication of these photos on any medium whatsoever.

17. No waiver

The fact that ELYSIS COLLECTION does not invoke any of the provisions of these General Conditions at a given time cannot be interpreted as a waiver by ELYSIS COLLECTION to invoke any of said provisions at a later date.

18. Applicable law and dispute resolution

18.1 Dispute Resolution

Individual Clients

In the event of a dispute between ELYSIS COLLECTION and the Client, the Client may contact customer service:​

If the dispute is not resolved amicably, the Client may refer the matter free of charge to the consumer mediator associated with ELYSIS COLLECTION, namely AME CONSO, within one year from the written complaint addressed to ELYSIS COLLECTION.​

The referral to the consumer mediator should be made:​

  • By completing the form provided for this purpose on the AME CONSO website: www.mediationconso-ame.com;
  • Or by mail addressed to AME CONSO, 11 Place Dauphine – 75001 Paris.​

The Client must promptly inform ELYSIS COLLECTION of this referral. The Client and ELYSIS COLLECTION remain free to accept or reject the proposed solution and, if necessary, to bring the matter before the competent courts.​

Additionally, the European Commission has established an online dispute resolution platform accessible to consumer Clients: https://ec.europa.eu/consumers/odr

Note: The European Online Dispute Resolution (ODR) platform will be discontinued as of July 20, 2025. New complaints can no longer be submitted after March 20, 2025.

Professional Clients or Legal Entities

If the Client is a legal entity, ELYSIS COLLECTION and the Client will endeavor to resolve any dispute amicably. Failing an amicable resolution within one (1) month, each party may bring the dispute before the Commercial Court of Paris, to which the parties assign exclusive jurisdiction.​

18.2 Applicable law  

These General Conditions are governed by French law. Any disputes that may arise concerning their validity, interpretation, execution, consequences, and aftermath shall be submitted to the competent court of Paris.​

19. Partial Invalidity – Modifications to the General Conditions 

Should any clause of these General Conditions be or become unlawful, null, or void under applicable regulations or a final court decision, it shall be deemed unwritten, and the remaining provisions shall remain lawful and enforceable against the Clients.​

These conditions may be modified at any time without prior notice, in accordance with the provisions outlined in Article 3 herein. Such modifications take effect upon their publication on the Site and will apply only to reservations made after their publication. Clients are invited to consult, acknowledge, and download the General Conditions at the time of their reservation.​
